Terms of Service
The agreement between Obliqque Software (Karibu) and the hotel that uses the platform.

1. The service
Karibu is a browser-based hotel property-management system for independent hotels: reservations, guests, rooms, billing, housekeeping, optional room service, reports, a public hotel mini-site / booking page, and related tools. It is offered as software-as-a-service at karibuapp.com and works offline for core desk workflows via a progressive web app cache.
“You” means the hotel business that opens the account (and its staff who are given access). “We” means Obliqque Software, trading as Karibu.
You must be authorised to bind the hotel. The service is for commercial hospitality operations, not personal consumer use.
2. Accounts and staff
You keep usernames and passwords confidential and are responsible for activity under your hotel’s accounts. Tell us if you believe an account is compromised. We may suspend access to protect the platform or other customers.
Invited staff must accept these Terms the first time they use the app (and again if we publish a new version). You are responsible for the people you invite and for removing access when they leave.
3. Plans, trial, billing
Current list prices are shown on karibuapp.com pricing and may be updated there. As of the effective date, default USD monthly prices and limits are:

- New hotels receive a 30-day Business-tier trial. No card is required. After the trial the hotel stays on Free unless you upgrade.
- Paid plans are billed through Stripe. Annual billing is 10 months (2 months free).
- You may cancel at any time. Access continues until the end of the paid period. We do not refund unused days in the current period.
- Feature limits (rooms, users, WhatsApp, booking engine, exports, and similar) follow the plan you are on. Exceeding a limit may block that feature until you upgrade or reduce usage.
Taxes may be added where required. Failed payments can downgrade or suspend paid features.
4. Your content and guest data (processor clause)
You retain ownership of hotel content and guest records you put in Karibu. You grant us a licence to host, back up, and display that data solely to provide the service.
For personal data of your guests and other people you enter (names, contact details, ID numbers, stays, invoices):
- You are the controller. You decide why it is collected and must have a lawful basis (typically a contract with the guest, or a legal duty). You must not store data that is unrelated to legitimate hotel operations.
- We are the processor. We process that data only on your documented instructions — which are: operate Karibu for your hotel, including reservations, billing, housekeeping, the public booking page, and support you request.
- We will not use guest personal data to market Karibu to those guests, and we will not share it with other hotels.
- Staff who handle data for us are under confidentiality. We use the sub-processors listed in the Privacy Policy. We will notify you of material sub-processor changes via this site or email when practical.
- We apply technical and organisational measures described in the Privacy Policy (HTTPS, row-level security, Auth-hosted passwords, access logging).
- If we become aware of a personal-data breach affecting your tenant data, we will notify you without undue delay so you can meet your own notification duties.
- We will assist you, within the product’s capabilities, with guest access/deletion requests you cannot complete yourself. After the service ends we delete or return tenant data as in section 8, except data we must keep by law.
The public booking page is your hotel site running on our infrastructure. Cookie and privacy notices toward website visitors of that page are your responsibility as controller of that interface, except for Karibu’s own essential/analytics cookies which we disclose in the Privacy Policy.
5. Acceptable use
You must not, and must not allow staff or guests to:
- Use Karibu for illegal activity, including trafficking, unlicensed accommodation where the law requires a licence, or fraud.
- Send spam or bulk unsolicited messages through WhatsApp or email features.
- Probe, scrape, or overload the service; reverse engineer except as allowed by mandatory law; resell access without our written permission.
- Upload malware or content that infringes others’ rights.
- Circumvent plan limits, billing, or security controls.
We may remove content or suspend an account that violates this section.
6. Availability and changes
We aim for reliable uptime but do not warrant uninterrupted or error-free service. Force majeure includes network outages, power failures, and failures of our hosting or payment providers.
We may change features, provided we do not remove the core PMS without notice. We may update these Terms. Material changes will be posted at least 30 days in advance when practical (email to the admin recovery address and/or an in-app acceptance gate). Continued use after you accept the new version is agreement to it. If you do not agree, you must stop using the service and export your data.
7. Intellectual property
Karibu software, design, and trademarks remain ours. You may not copy the product except for your authorised use of the hosted service.
8. Suspension, cancellation, inactivity
You may cancel in the app (or by emailing us). We may suspend or close an account for non-payment, abuse, or legal risk.
Hotels with no meaningful activity may be warned and then removed after the inactivity window described in the product (typically a warning around day 25 and deletion around day 30, then a short grace period). Export data before that if you still need it.
After cancellation we keep tenant data for about 90 days so you can request an export (CSV/JSON where we support it), then we delete it except tax records (up to 7 years) and audit logs (about 2 years).
9. Disclaimers and liability
The service is provided “as is.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent the law allows. You are responsible for checking guests in correctly, collecting amounts due, and complying with local hotel, tax, and data-protection law.
To the extent permitted by law, we are not liable for lost profits, lost bookings, or indirect damages, or for issues caused by your internet connection, devices, or third-party networks. Our total liability arising out of these Terms is limited to the fees you paid us for the service in the 12 months before the claim (or USD 100 if you are on Free).
Nothing excludes liability that cannot be limited (for example fraud, or death/personal injury caused by negligence, where such a rule applies).
10. Governing law
These Terms are governed by the laws of the Democratic Republic of the Congo, without regard to conflict-of-law rules. Courts of Kinshasa have jurisdiction, except that we may seek injunctive relief in any forum to protect the service. If mandatory law of your country of establishment gives you a right to sue locally, that right is not displaced.
